Key Issues Associated With Zostavax Lawsuit

By Frances Hill

So many vaccines have been manufactured over the centuries, but some of them have been found to be ineffective and dangerous. When this happens, the vaccine has to be canceled from the market and is no longer usable. Shingle is an infection that is caused by a dormant Varicella Zoster Virus that reactivates in the body. This happens after one contracts Chickenpox or Varicella during childhood. The virus remains in the spinal cord and brain and revives after many years as shingles virus. The vaccine that was developed is supposed to help the body fight the infection. However, people filed cases against this vaccine, and the following is an illustration of why the Zostavax Lawsuit is Legit.

Shingles is most common in adults who are about fifty years and above. To contract this virus, you must have previously contracted chickenpox or have other immune-related issues. The vaccine for shingles is available for patients who are fifty years or older.

Nevertheless, this vaccine is only effective for half the population, and it lasts six years in the body. The other half of the population is immunocompromised. This means that they cannot survive even the weakest form of the shingles virus. Thus, these patients can contract shingles if they are vaccinated using the vaccine. Most patients who were immunized using the Zostavax vaccine developed serious injuries such as paralysis, hearing loss, blindness, and liver failure.

The people that developed these injuries filed indictments against the shingles vaccine. These claims showed that Merck and Company had prior knowledge of the effects of the vaccine way before and during the pre and post-market approval. They, however, did not disclose this until seven years later after being approved by the FDA.

Currently, there are more than fifty claims that have been filed against Merck and CO, the pharmaceutical company that developed the drug. The indictment claims that the vaccine can cause serious and fatal injuries. It also claims that the defendants knew of the side effects but failed to warn consumers. Also, the defendants willfully, intentionally and knowingly misrepresented the safety of the vaccine.

If you developed shingles, or your loved one did after being immunized, you may qualify to file a claim against the vaccination. However, you must have been vaccinated after the year 2006. More so, the shingles virus must have characterized itself after 3 weeks to one year of being vaccinated. Also, the diagnosis must be clinically proved.

You can also file claims against the vaccine if you contracted some injuries within two years of being vaccinated. The damages include neurological disorders, PHN, myelitis, hearing loss, autoimmune diseases, stroke, cardiovascular problems, vasculitis, pneumonia, congestive heart failure, and death.

For you and your loved ones to be compensated for the injuries, you must file claims against Merck and CO. After that, you may be eligible to receive both economic and non-economic compensation for the damages that you have suffered. Hence, if you have suffered any injuries as a result of the vaccine, file a claim today.
