The Various Areas Covered In Barwinners

By Cecile Ingram

The intention of the Barwinners is to prepare students to take their bar exams. Some of the areas covered include the following. The first one is tort. Tort may be defined as a wrongful act which causes one to suffer injuries and may lead to legal liability.

Tort is a wrongful act which is punishable in law. Some of the elements of tort are that the person aggrieved by the action of the other person must establish that the person, who has aggrieved him or her, was compelled by the law not to behave in the manner in which they behaved.

The other issue is that the person aggrieved must show that the person responsible for the conduct breached the law by behaving in the way they did. The last issue to consider under tort is that the person aggrieved by the conduct must show that they have been affected by the conduct and that they have suffered loss as a result. These issues must be clearly demonstrated for one to bring an action against the other for having committed a tort.

The other subject is on contract law. Contract law is a set of laws which governs the contracts which people enter into. Contract on the other hand is an agreement which is entered into by two individuals or two legal personalities with specific terms to be fulfilled by each party. In order to prove the validity of a contract, one must prove the existence of the following element.

The parties or the entities must be of legal capacity to enter into such contract. The parties or the entities must also have the intention to create a legal relation. These are some of the elements of a valid contract as highlighted in the Barwinners.

The other topic is on criminal law. Criminal law is a group of rules and regulations that deter people from committing crimes. In criminal law, the complainant must establish that the accused person had intention of doing whatever they did. The intention may be proved if the accused person planned to commit the crime in prior.

Other than the criminal law, the area of evidence law is also covered. Evidence law may be described as the rules and regulations that govern the way facts are proved in a regal proceeding. These rules include the legal principles used to determine which evidence can be adduced in court and the one which cannot be adduced. They also guide on the evidence which is admissible as well as those that are not admissible in court of law.

Constitutional law is also another subject considered in the Barwinners. Constitution is the ultimate law in a given country providing for the operation of the various arms of the government, that is, the legislature and the judiciary. These different arms of the government are guided by the constitution. The constitution is superior to all other laws in the country. These subjects are adequately covered in the Barwinners.
