Facts On CDL Suspension Cases

Commercial Divers Licenses or the CDLs are individual driving licenses issued to drivers who operate commercial vehicles. Most road accidents are attributed to commercial vehicles, and this is why the laws governing commercial vehicles drivers have to be stricter compared to those regulating the issuance of private licenses and implement CDL suspension whenever necessary.

In the event of misconduct by any CDL holder, the law has it that their licenses be suspended, withdrawn or revoked. All states have their state legislation that governs the issuance and debarment of these permits. However, there are no significant differences in this regulation from state to state.

With the increasing number of mayhem in our roads that are caused by the commercial vehicle driver, the suspension of their licenses was aimed at bringing them back to their sense. It should be noted that a driver should not drive any commercial vehicle once their CDL has been suspended. They should pass the information on their debarment to their employers promptly.

The employer should not willingly allow a driver to drive a commercial vehicle during the time of debarment. If this happens, the employer will be viewed as an offender where they will be charged, and a verdict is given depending on the circumstances.

Some reasons lead to suspension of licenses. Alcohol influence while driving seems to be the major cause. One is at the risk of having the CDL suspended if they are found to have more than 0.04% of alcohol in their system. Almost all states have recorded this as being the primary cause of suspending of CDLs.

One should be supportive whenever they come into contact with traffic officials while on a road. It is an offense for one to refuse to give samples to the officers so that they conduct a checking on how sober you are. Such an offense is enough to have ones license be revoked. Though it may sound not fair, this is a fact that people must swallow.

Another cause of suspension that gets most drivers by surprise is the accumulating rule. Just as the name suggests, this rules works by accumulation the minor offenses that a driver conducts such as over speeding, failure to observe the rules and many others. Each rule has its number of points that the driver earns in the informational history database. Once a given number of stipulated points are reached over a specified period the driver gets a suspension.

Transporting or being under the influence of hard drugs especially narcotics is an additional reason that leads to the suspension of licenses. It had come to the attention of traffic officers that commercial vehicles are mostly used for the transportation of these drugs. This is why such an offense is treated with seriousness including suspensions of these licenses.

As a driver moves from state to state, the traffic officers can be able to learn about their past records by retrieving their information from these databases. Additionally, each state has its duration of debarment regarding a particular offense. However, the offense of transportation of narcotics leads to a permanent suspension of ones CDL.
