At any specific moment the many different law enforcement authorities are investigating hundreds of thousands of crimes. This means that there is always a very large number of people that are under investigation or that are suspected of committing crimes. Thousands of arrests are made each year. No one under investigation or that has been arrested should try and manage the situation without help from a New Jersey criminal defense attorney.

Any investigative authority, without exception, has to respect the inalienable rights that every citizen enjoys in terms of the constitution. These rights remains valid even if the suspect is investigated or arrested for the most heinous crimes imaginable. One of these rights is to have legal representation and another is to refuse to answer questions or make statements without the lawyer being present.

Despite the fact that arrested people are informed of their rights, many still think that the can get sympathy or lenience if the agree to answer questions and makes statements without a lawyer being present. This is certainly not a recommended course of action. The legal system is complex and accused can easily say something that may prove to be to their detriment at a later stage and in court.

Once a lawyer agrees to take on a case he will first make sure that the arrest has been handled according to procedures and that the rights of the accused have been observed at all times. He will obtain all the relevant facts from the arresting authority and then he will do his best to obtain bail for his client. He will also advise his client to communicate with nobody about the case before clearing it with the lawyer.

It is vital that anyone that has been freed on bail strictly observe the bail conditions. In most instances the accused must report to a police station at prescribed times and intervals. He is not allowed to travel without permission and he may not contact witnesses or others involved in the case in any manner. Failure to comply with the bail conditions can result in additional charges and a cancellation of the bail.

One of the biggest headaches of lawyers is that their clients do not always tell them the truth or they conceal certain facts. It is very important to be truthful to the lawyer. If he does not have all the facts and the full truth he may not be able to prepare an efficient defence. There have been many instances of lawyer refusing to continue with a case simply because they client is not truthful.

Very few people actively plan ahead for the eventuality that they may be accused of a crime or even arrested. Yet this happens to thousands of ordinary citizens each year. Legal fees can be extremely high and court cases can cost a large fortune. It may be a good idea to consider purchasing a policy from a reputable insurer that will pay for legal representation.

Nobody wants to be part of a criminal investigation but thousands of people are. Sometimes people just act irrationally, or make poor decisions or show bad judgement by drinking and then driving, for example. Whatever, happened, when in trouble with law enforcement authorities the first priority is to get legal representation.
