Importance Of Setting Up A Family Trust

By Thomas McDonald

If you have a lot of wealth, then issues about wealth reduction, wealth transition, and tax reduction constitute a significant concern. However, these problems can be addressed collectively by acquiring a family trust also known as discretionary plan. This is a contract where an individual allows a firm to hold his properties and asset for the benefit of his family members. Its primary role is to guard and handle assets on behave of the current and future generation. There are many advantages that come with acquiring the plan.

A discretionary provides creditors with protection. All properties that are under its control are guarded against creditors of both the beneficiaries and trustees. For instance, a parent could be having a lot of debts. If they cannot be able to clear them, they may decide to transfer the properties to a the plan to protect their children.

They also protect against relationship property claims. Usually, personnel assets given to children in the will are also available to their partners according to the property relationship act. However, if the property is either owned by the firm or given on your death, your kids can continue to receive benefits from the asset but they are not part of their personal properties, and hence partners of your children cannot claim them. Additionally, if the property is owned by a trust before entering into a relationship, your partner cannot claim them at the end of the relationship.

Discretionary trusts also offer protection of your property from beneficiaries. For instance, a parent may be undecided to write a will and leave his entire asset to the children especially if they have poor financial management ability. In this case, they may decide to leave the assets under a trust who use them to help the needy and vulnerable children.

It also helps to prevent any claims against your assets in case of death. For instance, the court has the power to rewrite a will if it judges that some members of your family were highly disadvantaged under the protection act. Fortunately, they have no powers to rewrite the policy for family protection act purposes.

They aid in protecting relatives who need special medical attention or are longer self-governing due to old age or other factors. Some members may be determined to resume the family properties upon the death of the settler. In this case, the settler can transfer all the properties to trust so that even those with special needs will be getting benefits.

They also help in protecting your properties from potential tax law amendments in future. For example, the government may decide to impose wealth taxes such as death duties and inheritance tax. In this case, the law will not affect your properties if they are already transferred to the policy.

Lastly, they play a significant role in estate planning. As earlier mentioned, whenever assets are transferred it, they seize to become the personal property of the settler, either when alive or dead. Therefore, a settler should always be protected on issues concerning bankruptcy and provision.
